By accessing or using the Rendezoo website, mobile applications, or any other services provided by Rendezoo Inc. ("Rendezoo") (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Services. We reserve the right to modify these terms at any time, and your continued use of the Services constitutes acceptance of those changes.

2. Eligibility and Accounts

Age Requirements: You must be at least 18 years old to create an account. Accuracy: You agree to provide accurate and complete registration information and to keep your credentials secure. You are solely responsible for all activity that occurs under your account.

3. Your Content

Ownership: You retain ownership of any text, images, or other materials you post ("Your Content"). License: By posting Your Content, you grant Rendezoo a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, and sub-licensable license to use, display, modify, and distribute Your Content to provide and promote the Services. Responsibility: You represent that you have all necessary rights to Your Content and that it does not infringe on any third-party rights.

4. Acceptable Use

You agree not to use Rendezoo for any unlawful or prohibited purpose. Prohibited actions include: Illegal Acts: Violating local, state, or international laws, including regulations regarding age-restricted content like alcohol or cannabis. Harmful Conduct: Posting content that is abusive, threatening, defamatory, or hateful. Technical Interference: Distributing viruses, scraping data without permission, or attempting to disrupt Rendezoo's systems. Impersonation: Pretending to be another person or entity.

5. Role in Events

Rendezoo is a platform, not an event organizer. All events listed are organized and managed by independent hosts. Rendezoo is not responsible for: • Event cancellations or changes. • The conduct or safety of any users you meet through the Services. • The accuracy or quality of information provided by hosts.

6. Payments, Fees, and Taxes

Fees: You are responsible for all fees and applicable taxes for purchases made through the Services. Taxes: Hosts are solely responsible for determining, collecting, and remitting any applicable sales taxes. Refunds: All purchases are generally final and non-refundable through Rendezoo; any refund requests must be directed to the event host. Chargebacks: Users may be held liable for any costs associated with illegitimate credit card chargebacks.

7. Third-Party Services

Our Services may contain links to third-party websites or integrate with services like Stripe for payment processing. Rendezoo does not control these third parties and is not liable for their content, privacy practices, or performance.

8. Disclaimers and Limitation of Liability

"As Is": The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. Limitation of Liability: To the fullest extent permitted by law, Rendezoo shall not be liable for any indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid us in the previous 12 months.

9. Indemnification

You agree to defend and indemnify Rendezoo and its affiliates from any claims, damages, or expenses (including legal fees) arising from your use of the Services, your Content, or your violation of these Terms.

10. Termination

Rendezoo reserves the right to suspend or terminate your account at its sole discretion, with or without notice, for violations of these Terms or for any other reason.

11. Dispute Resolution

Arbitration: You agree to resolve any disputes exclusively through binding individual arbitration. Class Action Waiver: You waive the right to participate in a class-action lawsuit or class-wide arbitration. Governing Law: These terms are governed by the laws of North Carolina.

12. Copyright (DMCA)

If you believe your work has been copied in a way that constitutes copyright infringement, please contact our designated agent at support@rendezoo.com with the required statutory information.

13. SMS/Text Messaging Terms

Program Description: Rendezoo operates two separate SMS programs and you choose each one independently. During ticket checkout you may opt in to a single transactional SMS confirming that specific purchase. You may also select a distinct promotional opt-in checkbox at checkout, or enable text notifications in account settings, to receive recurring promotional messages about upcoming events. Account Verification Codes: When you verify your mobile number, the one-time code is delivered by Google Firebase Authentication, a separate service. Those codes are not part of either SMS program described here, do not use Rendezoo's messaging number, and receiving one does not opt you in to any Rendezoo text messages. Message Frequency: Before we send you any promotional message, we text you a confirmation of your promotional opt-in with help and opt-out instructions. After that, promotional message frequency varies. A ticket-confirmation opt-in produces one message for that completed purchase. Message and Data Rates: Message and data rates may apply. Contact your wireless carrier for details about your plan. Opt-Out: Text STOP to any Rendezoo promotional or ticket-confirmation message at any time to opt out; you'll receive one final confirmation message. You can also disable promotional text notifications from your profile settings. Help: Text HELP to any Rendezoo promotional or ticket-confirmation message, or contact us at support@rendezoo.com, for assistance. Carriers: Supported carriers are not liable for delayed or undelivered messages. Not a Condition of Purchase: Both promotional and ticket-confirmation SMS choices are optional.
